RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MORRO BAY, CALIFORNIA
DENYING THE APPEAL OF THE PLANNING COMMISSION ACTION
WHICH APPROVED CONDITIONAL USE PERMIT (UP0-468) TO ALLOW
FOR THE CONTINUED OPERATION OF AN AUTO-BODY AND PAINT
BUSINESS AT 340 JAMAICA STREET.

City of Morro Bay, California
WHEREAS, the Planning Commission of the City of Morro Bay conducted public hearing
at the Morro Bay Veteran’s Hall, 209 Surf Street, Morro Bay, California, on March 7, 2017 for the
purpose of considering Conditional Use Permit (UP0-468) (“the Project”); and
WHEREAS, on March 7, 2017, the Planning Commission of the City of Morro Bay adopted
Resolution 06-17 to approve Conditional Use Permit (UP0-468); and
WHEREAS, on March 13, 2017, an appeal of the Planning Commission action to approve
the project was filed with the City of Morro Bay by Roy Cinowalt, specifically requesting the City
Council overturn the Planning Commission’s approval and deny the project; and
WHEREAS, on March 17, 2017, an appeal of the Planning Commission action to approve
the project was filed with the City of Morro Bay by Evans Cowan, Daryl Dobson, and Daniel Knight,
specifically requesting the City Council overturn the Planning Commission’s approval and deny
the project; and
WHEREAS, the City Council conducted a public hearing at the Morro Bay Veteran’s Hall,
209 Surf Street, Morro Bay, California, on May 23, 2017, to consider an appeal of the Planning
Commission’s approval of the project, located in an area outside of the appeals jurisdiction of the
California Coastal Commission; and
WHEREAS, notices of the public hearings were made at the time and in the manner
required by law; and
WHEREAS, the City Council has duly considered all evidence, including the
recommendations made by the Planning Commission, the testimony of the Appellants, the
testimony of the business owner, and the evaluation and recommendations by staff, presented at
said hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Morro Bay as
follows:
