HomeMy WebLinkAboutReso 26-17 joint agreement CDBGRESOLUTION NO. 26-17 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MORRO BAY, CALIFORNIA APPROVING A COOPERATION AGREEMENT BETWEEN THE COUNTY OF SAN LUIS OBISPO AND THE CITY OF MORRO BAY FOR JOINT PARTICIPATION IN THE URBAN COUNTY FOR PURPOSES OF RECEIVING, FEDERAL FUNDING UNDER COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM, THE HOME INVESTMENT PARTNERSHIP PROGRAM, AND THE EMERGENCY SOLUTIONS GRANT PROGRAM, FOR FISCAL YEARS 2018-2020 THE CITY COUNCIL City of Morro Bay, California WHEREAS, the County of San Luis Obispo, a political subdivision of the State of California (County), and the City of Morro Bay, a municipal corporation (the City), desire to participate in the Community Development Block Grant (CDBG) program (Program) administered by the U.S. Department of Housing and Urban Development (HUD); and WHEREAS, the Program will promote the public health, safety and welfare by providing grant funds to be used by the City and County to improve housing opportunities for low and moderate - income households, to encourage economic reinvestment, to improve community facilities and public services, and to provide other housing -related facilities, or services; and WHEREAS, the County submitted to the City a Notice of Opportunity to be included in the Urban County of San Luis Obispo for Purposes of Federal CDBG, HOME, and ESG Funding in a letter dated March 29, 2017; and WHEREAS, the County's May 14, 2014, letter states that under HUD regulation, the City must notify the County in writing whether the City elects to participate in the Urban County; and WHEREAS, the City desires to participate jointly with the County in said program and responded with an intent letter dated March 307 2017; and WHEREAS, City Council Resolution No. 75-15 authorized execution of a three-way agreement between the City, the City of Atascadero and the County signed on October 141 20167 which allowed for an advance of future years' allocation of CDBG funding; and WHEREAS, HUD requires those parties enter into a cooperation agreement to define their rights and obligations as a prerequisite of participation in the Program; and WHEREAS, the proposed 2018-2020 cooperation agreement is consistent with the General Plan and with City and County policies encouraging cooperation between agencies on issues of regional significance such as affordable housing and public improvements; and WHEREAS, the proposed cooperation agreement will promote the public health, safety and welfare by enabling the City and County to participate in the Program under an "urban county" 1 entitlement; thus making available funds for a variety of housing, economic development, and public services programs not otherwise available; and WHEREAS, the City and County enter into yearly subrecipient agreements which establish administrative policies and procedures, performance standards, and guidelines for funding specific CDBG programs and projects; and WHEREAS, the proposed cooperation agreement is not a "project" for purposes of compliance with the provisions of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Morro Bay, California, as follows: 1. The City Council hereby approves and authorizes the City Manager to participate and also enter into a cooperation agreement with the County to enable joint participation in the Program. 2. The City Manager or his/her designee is hereby authorized to act on behalf of the City in connection with the implementation of the agreement, ongoing operation of the Program, and other activities necessary to carry out the intent of the cooperation agreement.
