A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MORRO BAY, CALIFORNIA
ADOPTING AMENDMENT NO. 1 TO THE MEMORANDUM
OF UNDERSTANDING BETWEEN THE CITY OF MORRO BAY
AND THE MORRO BAY POLICE OFFICERS' ASSOCIATION
FOR THE PERIOD OF JULY 1, 2016 THROUGH JUNE 30, 2017
THE CITY COUNCIL

WHEREAS, the City of Morro _Bay (hereinafter the "City") has, and continues to, recognize
the Morro Bay Peace Officers' Association ("MBPOK) as the sole exclusive bargaining agent
for those City employees designated as being in the Law Enforcement Unit, including the
classification of Police Officer, Senior Officer, Corporal and Sergeant, for all matters concerning
wages, hours and working conditions; and
WHEREAS, the current Memorandum of Understanding between the City and the MBPOA
("MBPOA MOU 2016-2017"), which was duly approved by the City Council on August 23, 2016,
is scheduled to expire on June 30, 2017; and
WHEREAS, the City labor relations representatives and MBPOA representatives have
successfully met and conferred to negotiate an amendment to the MBPOA MOU 2016-2017,
pursuant to both the Meyers-Milias-Brown Act ("MMBA") (Gov't Code §§ 3500-3511) and the
City's Employer -Employee Relations Resolution No. 08-17, and have jointly prepared and
executed this Amendment No. 1 to the MBPOA MOU 2016-2017 ("First Amendment"), which
was ratified by the MBPOA on June 19, 2017; and
WHEREAS, the City and MBPOA have agreed in this First Amendment to make the
following amendments to the MBPOA MOU 2016-2017: i) extend the term of the MBPOA MOU
2016-2017 until June 30, 2018; ii) provide a two percent (2%) cost of living adjustment to all
MBPOA members effective July 1, 2017; iii) allow for payoff of compensatory time of up to 60
hours per fiscal year and allow MBPOA members to elect a payoff up to two times per year in
March and September; iv) update the City's contribution amounts toward employee health
benefits to reflect 2017 health contribution figures and add language allowing for further
negotiations for 2018 health benefits contributions; and v) remove now obsolete language
concerning probationary status for certain officers; and
WHEREAS, pursuant to Gov't Code § 3505.1, the City Council must approve the terms
of any memorandum of understanding or amendment thereto reflecting an agreement between
the City and the MBPOA.

Section 1,
The Amendment No. 1 to the MBPOA MOU 2016-2017, attached hereto as
Exhibit "A," is hereby approved.
Section 2. Except as expressly provided in Amendment No. 1 to the MBPOA MOU
2016-2017, all other provisions of the MBPOA MOU 2016-2017 shall remain in full force and
effect.

AMENDMENT NO. 1 TO THE MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF MORRO BAY AND THE MORRO BAY POLICE
OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 1, 2016 THROUGH
JUNE 30, 2017
WHEREAS, the City of Morro Bay (hereinafter the ty") has, and continues to,
recognize the Morro Bay Peace Officers' Association ("MBPOA") as the sole exclusive
bargaining agent for those City employees designated as being in the Law Enforcement Unit,
including the classification of Police Officer, Senior Officer, Corporal and Sergeant, for all
matters concerning wages, hours and working conditions; and
WHEREAS, the current Memorandum of Understanding between the City and the
MBPOA ("MBPOA MOU 2016-2017), which was duly approved by the City Council on
August 23, 2016, is scheduled to expire on June 30, 2017; and
WHEREAS, the City labor relations representatives and MBPOA representatives have
successfully met and conferred to negotiate an amendment to the MBPOA MOU 2016-2017,
pursuant to both the Meyers-Milias-Brown Act ("MMBA") (Gov't Code Section 3500-3511) and
the City's Employer -Employee Relations Resolution No. 0847, and have jointly prepared and
executed this Amendment No. 1 to the MBPOA MOU 2016-2017 ("First Amendment"), which
was ratified by the MBPOA on June 19, 2017 and remains subject to City Council determination
and approval; and
WHEREAS, this First Amendment shall not be in full force and effect until adopted by
resolution by the City Council of the City; and
WHEREAS, except as provided in this First Amendment, all other provisions of the
MBPOAM U 2016-2017 shall remain in full force and effect.
NOW, THEREFORE, it is hereby agreed that the MBPOA MOU 2016-2017 is amended in
the following particulars only:
Section 1. Art
icle 7 of the MBPOA MOU 2016-2017, entitled "Term," shall be
amended to read in its entirety as follows:
"ARTICLE 7- TERM
Except as otherwise specifically provided herein, the term of this MOU shall be from July 1,
2016, through June 30, 2018."
Section 2. Section 10.2.3, entitled "Compensatory Time Payoff," shall be amended to
read, in its entirety, as follows:
"10.2.3 Compensatory Time Payoff
Employees may elect a payoff of up to a maximum total of 60 hours per fiscal year of
accrued compensatory time. Upon 30 days' advance notice, partial or full payment will

be made on the second paycheck received in March and/or on the second paycheck in
September, as elected by the employee."
Section 3. Article 15 of the MBPOA MOU 2016-2017, entitled "Health Benefits,"
shall be amended to read, in its entirety, as follows:
"ARTICLE 15 -HEALTH BENEFITS
15.1 HEALTH INSURANCE
15.1.1 UNIT employees receive a cafeteria plan contribution, including the amount
required by Ca1PERS, as follows:
Employee only - up to $715/month or cost of insurance, whichever is less
Employee + 1 — up to $1,109/month or cost of insurance, whichever is less
Employee + family - up to $1,421/month or cost of insurance, whichever is less
15.2 DENTAL AND VISION INSURANCE:
15.2.1 During the term of this MOU, the CITY shall offer dental, life and vision
insurance, and each employee shall be required to carry both dental, life and
vision insurance for self. Life Insurance is provided at $50,000 per employee.
The following rates are effective January 1, 2017:

CITY will pay the remaining premium for dental, life and vision.
15.3 Any coverage made available to future retirees, beyond COBRA time requirements,
shall be paid for by the retiree.
15.4 The provisions of this ARTICLE shall be binding on the parties through the remainder of
this MOU, and for the term of the MOU, which will be effective upon City Council
approval. The parties agree herewith to retain the option to re -open discussion, with
respect to this ARTICLE, for any changes to the 2018 health rates."
Section 4. Anew Section 18.4 shall be added to Art
icle 18 of the MBPOA MOU
2016-2017, entitled "Salaries," and shall read in its entirety as follows:

Section 5. Art
icle 21 of the MBPOA MOU 2016-2017, entitled "Probationary
Period," is hereby amended to read, in its entirety, as follows:

"ARTICLE 21- PROBATIONARY PERIOD
The probationary period for new officers and lateral hires shall be 12 months."
Section 6. In order to reflect salary increases effective July 1, 2017, Attachment
to the MBPOA MOU 2016-2017 shall be amended and replaced with Attachment "A-1,"
attached hereto and incorporated herein by this reference.
Section 7. Except as expressly provided in this First Amendment, all other provisions
of the MBPOA MOU 2016-2017 shall remain in full force and effect.
Section 8. This First Amendment shall not be in full force and effect until adopted by
resolution by the City Council of the City.
