HomeMy WebLinkAboutReso 49-22 06-14-22 90-90W Port House AssignmentRESOLUTION NO. 49-22 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MORRO BAY, CALIFORNIA ASSIGNING LEASE SITE 90-90W TO CALLENDER COMMERCIAL PROPERTIES, LLC, AND CONDITIONALLY AUTHORIZING THE MAYOR TO EXECUTE DOCUMENTS NECESSARY FOR THE ASSIGNMENT AND ASSUMPTION AT LEASE SITE 90-90W, LOCATED AT 885 EMBARCADERO ROAD, MORRO BAY THE CITY COUNCIL City of Morro Bay, California WHEREAS, the City of Morro Bay is the lessor of certain properties on the Morro Bay Waterfront described as City Tidelands leases and properties; and WHEREAS, since 2020, Smith Livestock, LLC (managing and controlling owner Sonny Smith) has been the lessee of Lease Site 90-90W, located at 885 Embarcadero Road and is a tenant in good standing; and WHEREAS, Smith Livestock, LLC is selling the leasehold interest and improvements to Callender Commercial Properties, LLC, a limited liability company whose managing and controlling owner is Cliff Branch; and WHEREAS, Smith Livestock and Callender Commercial Properties have satisfactorily submitted the necessary documents for the assignment and assumption. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Morro Bay, California, as follows: 1. The City Council approves the assignment and assumption of the leasehold interest at Lease Site 90-90W to Callender Commercial Properties, LLC 2. The Mayor is hereby authorized to execute said assignment and assumption, as approved by the City Attorney. PASSED AND ADOPTED by the City Council of the City of Morro Bay at a regular meeting thereof held on the 14th day of June, 2022 on the following vote: AYES° Headding, Addis, Barton, Ford, Heller NOES' None ABSENT: None John Rea ding, Mayor ATTEST: awil ana Swanson, City Clerk
