HomeMy WebLinkAboutReso 12-24 Adopting Amendment 2 to SEIU MOU effective February 13 2024RESOLUTION NO. 12-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MORRO BAY, CALIFORNIA ADOPTING AMENDMENT NO. 2 TO THE MEMORANDA OF UNDERSTANDING BETWEEN THE CITY OF MORRO BAY AND THE SEW LOCAL 620, TO PROVIDE MODIFICATIONS TO THE PAY SCHEDULE EFFECTIVE RETROACTIVE TO JULY 1, 2023 THE CITY COUNCIL City of Morro Bay, California WHEREAS, Section 36506 of the California Government Code requires that the City Council fix compensation of all appointive officers and employees by resolution or ordinance; WHEREAS, Morro Bay Municipal Code Title 2, Chapter 2.20, Section 2.20.020 requires that the salaries and compensation of officers and employees of the City shall be as fixed and determined by resolution of the City Council, after due consideration of employees' bargaining rights, as established by the Meyers-Milias-Brown Act, except those fixed in this chapter; and WHEREAS, the current Memorandum of Understanding between the City and SEIU ("SEIU MOU 2022-2024"), was duly approved by the City Council by Resolution No. 52-22 on June 14, 2022; and WHEREAS, the City's labor relations representatives and SEIU Local 620 representatives have successfully met and conferred to negotiate an amendment to the SEIU MOU 2022-2024 to reflect wage equity adjustments based on the results of the City's Total Class and Compensation Study effective July 1, 2023, pursuant to both the Meyers-Milias-Brown Act ("MMBA") (Gov't Code Section 3500-3511) and the City's Employer -Employee Relations Resolution No. 0&17, and have jointly prepared and executed this Amendment No. 2 to the SEIU MOU 2022-2024 ("Second Amendment"), which was ratified by the SEIU and remains subject to City Council determination and approval; and WHEREAS, pursuant to Gov't Code § 3505.1, the City Council shall vote to acceptor reject the terms of any tentative agreement, including any memoranda of understanding, or amendment thereto, reflecting an agreement between the City and its recognized employee organizations within 30 days of the date it is first considered at a duly noticed public meeting; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Morro Bay, California, as follows: Section 1. The City Council hereby authorizes, approves and adopts the following wage equity adjustments to the current pay schedules for the SEIU Local 620-represented employees in the job classifications of Assistant Planner, Recreation Supervisor, Harbor Business Coordinator, Harbor Patrol Supervisor and Harbor Patrol Officer, retroactive to the payroll period including July 1, 2023: SEIU Classification Title of Employees in Classification % Wage Increase Assistant Planner 1 3.50% Recreation Supervisor 2 5.00% Harbor Business Coordinator 1 4.00% Harbor Patrol Supervisor 1 8.00% Harbor Patrol Officer 4 3.00% SEIU Classification Title Current Tap Step Proposed Top Step Assistant Planner $ 38.22 $ AM Recreation Supervisor $ R99 $ 39.89 Harbor Business Coordinator $ 43.35 $ 45.08 Harbor Patrol Supervisor $ 4532 $ 49.38 Harbor Patrol Officer $ 38.82 $ 39.98 **Not all employees at top step Section 2. The Amendment No. 2 to the SEIU, Local 621 MOU 2022-2024, attached hereto as Exhibit 'I,' is hereby approved and adopted. PASSED AND ADOPTED by the City Council, City of Morro Bay at a regular meeting thereof held on the 13'h day of February 2024 by the following vote: AYES: NOES: ABSENT: ABSTAIN RECUSE; ATTEST: Wixom, Barton, Edwards, Ford, Landrum None None None None r NA SWANSON, City Clerk ra Exhibit "1" AMENDMENT NO. 2 TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MORRO BAY AND THE SERVICE EMPLOYEES INTERNATIONAL UNION (SEIU), LOCAL 620, FOR THE PERIOD OF JULY 1, 2022 THROUGH DUNE 30, 2024 WHEREAS, the City of Morro Bay (hereinafter the "City") has, and continues to, recognize the Service Employees International Union ("SEIU"), Local 620, as the sole exclusive employee organization representing the City's miscellaneous employees for all matters concerning wages, hours and wonting conditions; and WHEREAS, the current Memorandum of Understanding between the City and SEIU Local 620 ("SEIU MOU 2022-2024"), was duly approved by the City Council by Resolution No. 58-22 on June 14, 2022; and WHEREAS, at its Regular Meeting held October 10, 2023, the City Council adopted Resolution No. 66-23 approving Amendment No. 1 to the SEIU MOU 2022-2024 establishing an increase to the City's contribution toward the purchase of Ca1PERS health insurance effective December 1, 2023 for the 2024 health plan year; and WHEREAS, the City's labox relations representatives and SEIU Local 620 representatives have successfully met and conferred to negotiate an amendment to the SEIU MOU2022-2024 to reflect wage equity adjustments based on the results of the City's Total Class and Compensation Study to be effective July 1, 2023, pursuant to both the Meyers-Milias-Brown Act ("MMBA") (Gov't Code Section 3500-3511) and the City's Employer -Employee Relations Resolution No. 08-17, and have jointly prepared and executed this Amendment No. 2 to the SEIU MOU 2022- 2024 ("Second Amendment"), which was ratif ed by the SEIU and remains subject to City Council determination and approval; and WHEREAS, this Second Amendment shall not be in full force and effect until adopted by resolution by the City Council of the City; and WHEREAS, except as provided in this Second Amendment, all other provisions of the SEIU MOU 2022-2024 and .Amendment No. 1 thereto shall remain in full force and effect. NOW, THEREFORE, it is hereby agreed that the SEIU MOU 2022-2024 and Amendment No. 1 thereto are amended in the following particulars only: Section 18.6, 18.7, and 18.8 of the SEIU MOU 2022-2024, are deleted in theix entirety and replaced with the following new 18.6 only: 18.6 Attached Exhibit A reflects wages for UNIT members effective July 1, 2022. Exhibit B replaces the prior Exhibit B and reflects wages for UNIT members to be retroactively effective July 1, 2023.
