MINUTES - MORRO BAY CITY COUNCIL
CLOSED SESSION MEETING
August 13, 2024, 4:00 p.m.
City Hall Conference Room

1. ESTABLISH QUORUM AND CALL TO ORDER
Mayor Wixom established a quorum and called the meeting to order at 4:01 p.m.
2. SUMMARY OF CLOSED SESSION ITEMS
3. CLOSED SESSION PUBLIC COMMENT
Mayor Wixom opened public comment for items on the agenda; seeing none, the
public comment period was closed.
4. THE COUNCIL WILL CONVENE IN CLOSED SESSION
4.a CONFERENCE WITH REAL PROPERTY NEGOTIATOR -
GOVERNMENT CODE SECTION 54956.8
4.b CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to paragraph (2) of subdivision
(d) of Govt Code section 54956.9: one matter involving Ms. Betty
Winholtz's claim of a Brown Act violation by the Council at the July 10,
2024, Council closed session meeting. The claim from Ms. Betty Winholtz
is a public record available for public inspection and is attached to this
closed session agenda listing.
5. RECONVENE IN OPEN SESSION
The City Council reconvened in Open Session. City Attorney Neumeyer reported
that regarding Item 4.a., a review with real property negotiators for the property

generally known as the wastewater treatment facility, the Council directed that,
while no reportable action was taken, the Council had a productive discussion
and continues to move forward working with Cayucos figuring out what to do with
the site. Regarding Item 4.b., pursuant to the receipt of a Brown Act cure and
correct letter that Council received for the closed session meeting held July 10,
2024, the Council directed that a response be sent to the sender of that letter
reaffirming no final action was taken and that any Community Benefits
Agreement that the Council potentially could pass would be pursuant to review at
a public meeting, public input would be sought, that no community benefit
agreement was made by City Council, and that the response authorized to be
sent back to Vistra was tentative and non-binding.
6. ADJOURNMENT
The meeting adjourned at 5:21 p.m.
