HomeMy WebLinkAboutCC_2024-12-19 Special Meeting Minutes 1 MINUTES - MORRO BAY CITY COUNCIL SPECIAL MEETING OF CITY COUNCIL December 19, 2024, 5:30 p.m. Veterans Memorial Hall, 209 Surf St., Morro Bay, CA Members Present: Mayor Carla Wixom Council Member Cyndee Edwards Council Member Jeff Eckles Council Member Zara Landrum Council Member Bill Luffee Staff Present: City Manager Yvonne Kimball City Clerk Dana Swanson _____________________________________________________________________ 1. ESTABLISH QUORUM AND CALL TO ORDER Mayor Wixom called the meeting to order at 5:30 p.m. with all members present. 2. PUBLIC COMMENT FOR ITEMS ON THE AGENDA https://youtu.be/v2VfouX7W7c?si=siq2k08y64FckIzU&t=41  Janice Peters, Morro Bay, offered her support for retaining Mr. Schultz.  Linda Winters, Morro Bay, was supportive of hiring Mr. Schultz.  Jeremiah O'Brien, Morro Bay, welcomed Mr. Schultz back to the city if that's the direction of Council.  Judy Setting, Morro Bay, asked the Council vote to terminate the agreement with Brown, Williams and Sorensen and execute and agreement with Mr. Schultz.  Jeff Heller, Morro Bay, questioned why the decision to terminate the Brown Williams Sorensen contract was made so quickly and was concerned about the loss of institutional knowledge. He suggested Council develop policies and procedures to closely monitor consultant fees. End of public comment. 3. SPECIAL MEETING AGENDA ITEM(S) 3.a Consideration of Termination of the Agreement with Burke, Williams & Sorensen, LLP for City Attorney Services 2 https://youtu.be/v2VfouX7W7c?si=e9XJpouBLINQ-tpA&t=637 City Manager Kimball briefly introduced the item. Motion by Mayor Wixom Seconded by Council Member Luffee Direct staff to proceed with termination of the Agreement with Burke, Williams & Sorensen (BWS) to allow for a successor agreement, with the exception of closure on ongoing items between either BWS and Interim City Attorney or BWS and the City Manager. Ayes (5): Mayor Wixom, Council Member Edwards, Council Member Eckles, Council Member Landrum, and Council Member Luffee CARRIED (5 to 0) 3.b Approval of Agreement with Robert Schultz for Interim City Attorney Services https://youtu.be/v2VfouX7W7c?si=z-ne4h_xY3tqL3w0&t=1263 City Manager Kimball briefly introduced the item and Mayor Wixom invited Mr. Schultz to the podium to respond to Council inquiries. Following Council questions and discussion, there was consensus to strike the last sentence in Section 13 - Conflict of Interest and direct staff to verify whether a section title was missing in the paragraph following Section 15 - Indemnification. Motion by Mayor Wixom Seconded by Council Member Luffee Approve and authorize the Mayor to execute an Agreement with Robert W. Schultz for Interim City Attorney Services with the changes discussed. Ayes (5): Mayor Wixom, Council Member Edwards, Council Member Eckles, Council Member Landrum, and Council Member Luffee CARRIED (5 to 0) 4.
