HomeMy WebLinkAboutReso 23-25 Rescinding 103-22 and 104-22 and Approving a Flagpole Policy_v2 - signedRESOLUTION NO. 23-25 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MORRO BAY, CALIFORNIA, RESCINDING RESOLUTIONS 103-22 AND 104-22 AND RE-APPROVING THE CITY OF MORRO BAY’S FLAGPOLE POLICY T H E C I T Y C O U N C I L City of Morro Bay, California WHEREAS, the City of Morro Bay displays and handles all flags in accordance with Federal and State law; and WHEREAS, the City does not have local rules or guidelines regarding the display of flags at City facilities; and WHEREAS, the City wishes to adopt a policy to provide clear guidelines about the display of flags at City facilities that declares the City’s flagpoles are not intended to be a forum for free expression by the public, but rather are used to express official views of the City; and WHEREAS, said City facilities and flagpoles are under the exclusive control of the City and are not public forums for the expression of the view of the public; and WHEREAS, in November 2022, the City Council adopted Resolution No. 103-22 establishing the City’s Flagpole Policy and allowing for Commemorative Flags to be flown only upon the adoption of a resolution by a majority vote of the City Council; and WHEREAS, in November 2022, the City Council adopted Resolution No. 104-22 approving the flying of the Pride Flag at City Hall during the month of June of each year; and WHEREAS, the City Council desires to rescind Resolutions 103-22 and 104-22 and establish a Flagpole Policy that allows for only the United States flag, the State flag, and the City flag to be flown at City facilities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Morro Bay, California, as follows: 1. Effective July 1, 2025, Resolution Nos. 103-22 and 104-22 shall be rescinded, and 2. Effective July 1, 2025, Approves and Readopts the policy for the display of flags at City facilities as provided in Exhibit A attached hereto. Therefore, flag poles located at all City facilities may only be used to display the flags of the United States, the State of California, and the City of Morro Bay.
