HomeMy WebLinkAboutReso 38-17 SEIU MOU Amendment 1RESOLUTION NO. 38-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MORRO BAY, CALIFORNIA ADOPTING AMENDMENT NO. 1 TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MORRO BAY AND THE SERVICE EMPLOYEES INTERNATIONAL UNION (SEIU), LOCAL 620, FOR THE PERIOD OF JULY 11 2016 THROUGH JUNE 309 2017 THE CITY COUNCIL City of Morro Bay, California WHEREAS, the City of Morro Bay (hereinafter the "City") has, and continues to, recognize the Service Employees International Union, Local 620 ("SEIU Local 620") as the sole exclusive bargaining agent for the City's miscellaneous employees, for all matters concerning wages, hours and working conditions; and WHEREAS, the current Memorandum of Understanding between the City and SEIU Local 620 ("SEIU MOU 2016-2017"), which was duly approved by the City Council on August 23, 2016, is scheduled to expire on June 30, 2017; and WHEREAS, the City labor relations representatives and SEIU Local 620 representatives have successfully met and conferred to negotiate an amendment to the SEIU MOU 2016-2017, pursuant to both the Meyers-Milias-Brown Act ("MMBA") (Gov't Code §§ 3500-3511) and the City's Employer -Employee Relations Resolution No. 08-17, and have jointly prepared and executed this Amendment No. 1 to the SEIU MOU 2016-2017 ("First Amendment"), which was ratified by the SEIU Local 620 on June 21, 2017; and WHEREAS, the City and SEIU Local 620 have agreed in this First Amendment to make the following amendments to the SEIU MOU 2016-2017: i) extend the term of the SEIU MOU 2016-2017 until June 30, 2018; ii) update the City's contribution amounts toward employee health benefits to reflect 2017 health contribution figures and add language allowing for further negotiations for 2018 health benefits contributions; iii) provide a two percent (2%) cost of living adjustment to all SEIU members effective July 1, 2017; iv) add language allowing for further negotiations with respect to a 9/80 work schedule for SEIU Local 620 employees; v) add language allowing for further negotiations with respect to certificate pay for certain classifications; and vi) add language allowing for further negotiations with respect to salary equity adjustments for certain personnel; and WHEREAS, pursuant to Gov't Code § 3505.1, the City Council must approve the terms of any memorandum of understanding or amendment thereto reflecting an agreement between the City and SEIU Local 620. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Morro Bay, California, as follows: Section 1. The Amendment No. 1 to the SEIU MOU 2016-2017, attached hereto as Exhibit "A," is hereby approved. Section 2. Except as expressly provided in Amendment No. 1 to the SEIU MOU 2010- 2017, all other provisions of the SEIU MOU 2016-2017 shall remain in full force and effect. IT THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MORRO BAY AND THE SERVICE EMPLOYEES INTERNATIONAL UNION (SEIU), LOCAL 620, FOR THE PERIOD OF JULY 1, 2016 THROUGH JUNE 30, 2017 WHEREAS, the City %J Morro Bay (hereinafter the "City") has, and continues to, recognize the Service Employees International Union, Local 620 ("SEN Local 620"), as the sole exclusive bargaining agent for the City's miscellaneous employees, for all matters concerning wages, hours and working conditions; and WHEREAS, the current Memorandum of Understanding between the City and SEIU Local 620 ("SEIU MOU 2016-2017), which was duly approved by the City Council on August 23, 2016, is scheduled to expire on June 30, 2017; and WHEREAS, the City labor relations representatives and SEN Local 620 representatives have successfully met and conferred to negotiate an amendment to the SEIU MOU 2016-2017, pursuant to both the Meyers-Milias-Brown Act ("MMBA") (Gov't Code Section 3500-3511) and the City's Employer -Employee Relations Resolution No. 0847, and have jointly prepared and executed this Amendment No. 1 to the SEN MOU 2016-2017 ("First Amendment"), which was ratified by on'^ LZI and remains subject to City Council determination and approval; and WHEREAS, this. First Amendment shall not be in full force and effect until adopted by resolution by the City Council of the City; and WHEREAS, except as provided in this First Amendment, all other provisions of the SEIU MOU 2016-2017 shall remain in full force and effect. NOW, THEREFORE, it is hereby agreed that the SEIU MOU 2016-2017 is amended in the following part iculars only: Section 1. Article 7 of the SEIU MOU 2016-2017, entitled "Term," shall be amended to read in its entirety as follows: "ARTICLE 7- TERM Except as otherwise specifically provided herein, the term of this MOU shall be from July 1, 2016, through June 30, 2018." Section 2. Section 10.1 of the SEIU MOU 2016-2017, pert aining to the workday, is hereby amended to read, in its entirety, as follows: "10..1 Workday The normal workday shall be eight hours of work in a 24 consecutive hour period, except in cases of emergencies. Alternative work schedules can be implemented, upon approval of the City Manager, and providing they are not in violation of the Fair Labor Standards Act (FLSA) regulations. The parties agree herewith to retain the option to re -open discussion of this Section 10. 1, with respect to UNION's proposal for a 9/80 work schedule 01181.0026/384688.3 „� for non -safety employees, where all non -safety employees working locations would be closed one day every other week to accommodate such modified schedules." Section 3. Section 15.1.2 of the SEIU MOU 2016-2017 shall be amended to read, in its entirety, as follows: "15.1.2 UNIT employees receive a cafeteria plan contribution (including the amount required by Ca1FERS in 15. 1.1 above) as follows: Employee only - up to $715/month or cost of insurance, whichever is less Employee + 1 — up to $1,109/month or cost of insurance, whichever is less Employee + family - up to $1,421/month or cost of insurance, whichever is less" Section 4. Section 15.2 of the SEIU MOU 2016-2017, entitled "Dental, Life and Vision Insurance," shall be amended to read, in its entirety, as follows: "15.2 Dental, Life and Vision Insurance 15.2.1 Life Insurance is provided at $50,000 per employee. The following rates are effective January 1, 2016: CITY will pay the remaining premium for dental/life and vision." Section 5. Section 15.4 of the SEIU MOU 2016-2017 is hereby amended to read, in iL3 entirety, as follows: "15.4 The provisions of this ARTICLE shall be binding on the parties through the remainder of this MOU, and for the term of the MOU, which will be effective upon City Council approval. The parties agree herewith to retain the option to re -open discussion, with respect to this ARTICLE, for any changes to the 2018 health rates." Section 6. A new Section 18.8 shall be added to Article 18 of the SEIU MOU 2016- 2017, entitled "Wages and Incentives," and shall read in its entirety as follows: "18.8 Effective July 1, 2017, the CITY shall provide a COLA increase to base salaries for all UNIT classifications in the amount of two percent (2%)." Section 5. Section 15.4 of the SEIU MOU 2016-2017 is hereby amended to read, in iL3 entirety, as follows: "15.4 The provisions of this ARTICLE shall be binding on the parties through the remainder of this MOU, and for the term of the MOU, which will be effective upon City Council approval. The parties agree herewith to retain the option to re -open discussion, with respect to this ARTICLE, for any changes to the 2018 health rates." Section 6. A new Section 18.8 shall be added to Article 18 of the SEIU MOU 2016- 2017, entitled "Wages and Incentives," and shall read in its entirety as follows: "18.8 Effective July 1, 2017, the CITY shall provide a COLA increase to base salaries for all UNIT classifications in the amount of two percent (2%)." Section 7 A new Section 18.9 shall be added to Article 18 of the SEN MOU 2016- 2017, entitled "Wages and Incentives," and shall read in its entirety as follows: 18.9 The parties agree herewith to retain the option to re -open discussion of Sections 15.2 and 18.3 in this Article 18, with respect to additional certificate pay for those employee classifications listed in Section 18.2 and 18.3." Section S. Anew Section 18.10 shall be added to Article 1 S of the SEILT MOU 2016- 2017, entitled "Wages and Incentives," and shall read in its entirety as follows: "18.10 The parties agree herewith to retain the option to re -open discussion of salary equity adjustments proposed by the UNION for the following harbor personnel: Harbor Patrol Officer, Harbor Patrol Supervisor, Harbor Business Coordinator, and Associate Civil Engineer." Section 9. In order to reflect salary increases effective July 1, 2017, Exhibit "A" to the SEIU MOU 206-2017 shall be amended and replaced with Exhibit "A-1," attached hereto and incorporated herein by this reference. Section 10. Except as expressly provided in this First Amendment, all other provisions of the SEIU MOU 2016-2017 shall remain in full force and effect. Section 11 This First Amendment shall not be in full force and effect until adopted by resolution by the City Council of the City. Anew Section 18.10 shall be added. to Article 18 of the Sk:ll.l MOC1201(i- 2017, entitled "Wages and Incentives," and shall read in its entirety as follows: "18.10 T'he parties agree herewith to retain the option to re -open discussion of salary equity adjustments proposed by the UNION for the following harbor personnel; Harbor Patrol Officer, Harbor Patrol Supervisor, Harbor Business Coordinator, and Associate Civil Engineer." Section 9. In order to reflect salary increases effective July 1, 2017, Exhibit "A" to the S1 lU MOU 206-2017 shall be amended and replaced with Exhibit "A-1," attached hereto atad incorporated herein by this reference. Section 10. Except as expressly provided in this First Amendment, ail other provisions of the SETU MOLD 2016-2017 shall remain in full force and effect. Section 11.
