HomeMy WebLinkAboutReso 75-18 SRF Application**61101061,lk skik f- • • is • STATEOF THE CITY OF MORRO BAY, CALIFORNIA AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPLY FOR •LVING FUND FINANCIAL ASSISTANCEFOR i • •F THE WATER RECLAMATION. iM THE STATE WATER QUALITY • • ACTION30ARD AND AUTHORIZING THE EXECUTION OF A LOAN AGREEMENT, AND ANY OTHER • FOR THE PURPOSESOF •. ity of Morro Bay, California WHEREAS, the City of Morro Bay ("City") is actively pursuing development of a Water Reclamation Facility (the "Project") that will provide treated disinfected recycled water to supplement the City's water portfolio; and WHEREAS, the State of California State Water Resources Control Board (SWRCB) has State Revolving Fund (SRF) loan funding available for the construction of the Project; and WHEREAS, it is in the public interest to pursue SRF loan funding for the Project; and WHEREAS, the SWRCB requires the City to authorize a designated representative to sign and file on behalf of the City an SRF Loan Application to obtain a loan to fund construction efforts for the Water Reclamation Facility; and WHEREAS, the SWRCB requires the City to provide the assurances, certifications and commitments required for the SRF Loan Application, including executing an SRF Loan Agreement with the SWRCB and any amendment or changes thereto; and WHEREAS, SWRCB requires the City to designate a representative of the City to carry out the City's responsibilities under the Loan Agreement, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws. NOW, THEREFORE, BE IT RESOLVED by the City Council of -the City of Morro Bay, as follows: 1. The Public Works Director/City Engineer is hereby authorized and directed to sign and file, for and on behalf of the City, a Financial Assistance Application for a financing agreement from the State Water Resources Control Board for the planning, design, and construction of Water Reclamation Facility (the "Project"); and 2. If funding is approved, the Public Works Director/City Engineer is hereby authorized to sign the loan agreement, subject to approval by the City Attorney, and take other actions as required by the agreement; and 3. The Public Works Director/City Engineer is hereby designated to provide the assurances, certifications, and commitments required for the financial assistance application, including executing a financial assistance agreement from the State Water Resources Control Board and any amendments or changes thereto. The Public Works Director/City Engineer is hereby designated to represent the City in carrying out the City's responsibilities under the financing agreement, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws.
