HomeMy WebLinkAboutReso 02-16 Appeal of the PC Dening Coastal Development Permit CP0-410 & Conditional Use Permit UP0-369RESOLUTION NO. 02-16 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MORRO BAY, CALIFORNIA GRANTING THE APPEAL OF THE PLANNING COMMISSION WHICH DENIED COASTAL DEVELOPMENT PERMIT (CP0410) AND CONDITIONAL USE PERMIT (UPO-369) AND RETURNING THE PROJECT TO THE PLANNING COMMISSION FOR REVIEW BASED ON REVISED PLANS DATED DECEMBER 14, 2015 TO ALLOW CONSTRUCTION OF A NEW 39341 SQUARE FOOT SINGLE-FAMILY RESIDENCE WITH 356 SQUARE FOOT OF DECKING, 236 SQUARE FOOT COVERED PORCH AND 520 SQUARE FOOT GARAGE AT 289 MAIN STREET THE CITY COUNCIL City of Morro Bay, California WHEREAS, the Planning Commission of the City of Morro Bay conducted public hearings at the Morro Bay Veteran's Hall, 209 Surf Street, Morro Bay, California, on September 1, 2015 and October 6, 2015, for the purpose of considering Coastal Development Permit (CPO- 410) and Conditional Use Permit (UPO-369) ("the Project"); and WHEREAS, on October 20, 2015, the Planning Commission of the City of Morro Bay adopted Resolution 40-15 to deny Coastal Development Permit (CPO-410) and Conditional Use Permit (UPO-369) based on lack of neighborhood compatibility related to bulk, size, and scale; and WHEREAS, on October 30, 2015, an appeal of the Planning Commission action to deny the project was filed with the City of Morro Bay by the Applicants, John and Alair Hough, specifically requesting the City Council overturn the Planning Commission's denial and approve the project; and WHEREAS, on December 14, 2015, the City of Morro Bay received revised plans by the Applicant with architectural changes intended to reduce the bulk, size and scale of the project; and WHEREAS, the City Council conducted a public hearing at the Morro Bay Veteran's Hall, 209 Surf Street, Morro Bay, California, on January 12, 2016, to consider an appeal of the Planning Commission's denial of the project, located in an area within the appeals jurisdiction of the California Coastal Commission; and WHEREAS, notices of the public hearings were made at the time and in the manner required by law; and 01181.0005/279970.1 City Council Resolution 902-16 Appeal of CP0410 & UPO-369 289 Main Street Page 2 WHEREAS, the City Council has duly considered all evidence, including the recommendations made by the Planning Commission, the testimony of the applicant, the applicant's revised plans and revised visual simulations, interested parties, and the evaluation and recommendations by staff, presented at said hearing. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Morro Bay as follows: Section 1: Due to the new plans presented by applicant for the project on December 14, 2015, the City Council grants the appeal for the purpose of returning the project to the Planning Commission for review and decision.
