A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF MORRO BAY, CALIFORNIA
PROVIDING FOR DEFERRAL OF TIDELANDS TRUST
MASTER LEASE RENT PAYMENTS FOR THE MONTHS OF
MARCH, APRIL, MAY AND JUNE, 2020 DO TO THE
COVID-19 PANDEMIC BUSINESS CLOSURES
THE CITY COUNCIL
City of Morro Bay California
WHEREAS, the California Governor on March 4, 2020 proclaimed a State of Emergency
to exist in California due to the COVID-19 pandemic, and
WHEREAS, the President of the United States on March 13, 2020 declared the outbreak
of COVID-19 in the United States constituted a national emergency; and
WHEREAS, on March 13, 2020, the San Luis Obispo County Emergency Services
Director issued a Proclamation of Local Emergency due to the spread of COVID-19 in the
County of San Luis Obispo; and
WHEREAS, on March 14, 2020, the Morro Bay City Manager proclaimed a declaration of
the existence of a local emergency within the City due to the threat posed from COVID-19, and
that declaration was subsequently ratified by the City Council on March 19, 2020; and
WHEREAS, due to the unprecedented business closures and other restrictions
implemented in response to the COVID-19 pandemic affecting business and other activity in
Morro Bay, many Tidelands Trust waterfront lease Master Tenants and Subtenants are unable
to make their rent and other payment obligations; and
WHEREAS, the City Council now desires to implement immediate measures to mitigate
the financial situation of Morro Bay's Tidelands Trust tenants in order to help assure a speedy
financial recovery from pandemic.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Morro Bay,
California, as follows:
Effective immediately:
1. All Tidelands Trust Master Tenants may defer their monthly lease rent payments for
the months of March, April, May and June 2020 if needed, without penalty or late
fees being assessed.
2. The same provision to defer rent payments will be extended to Tidelands Trust
Subtenants by Master Tenants, if needed.
DE IT FURTHER RESOLVED, by the City Council of the City of Morro Bay, California,
as follows:
Deferred rent amounts will remain on -account and the City Council will work in good faith
with Tidelands Trust Master Tenants to develop deferred rent payment or other plans at a future
time to be determined.
PASSED AND ADOPTED by the City Council, City of Morro Bay at a special meeting
thereof held on the 28th day of April 2020 by the following vote:
