HomeMy WebLinkAboutReso 24-21 Cloisters eng rpt resolution intentRESOLUTION NO. 24-21 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MORRO BAY, CALIFORNIA, DECLARING THE CITY'S INTENTION TO LEVY THE ANNUAL ASSESSMENT FOR CLOISTERS LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT PURSUANT TO THE "LANDSCAPING AND LIGHTING ACT OF 1972" (STREETS AND HIGHWAYS SECTIONS 22500 ET.SEQ) FOR FISCAL YEAR 2021/22 THE CITY COUNCIL City of Morro Bay, California WHEREAS, all property owners of the Cloisters subdivision requested the City of Morro Bay form a maintenance assessment district to fund the maintenance of the Cloisters Park and Open Space; and WHEREAS, the Landscaping and Lighting Act of 1972 (Streets and Highways Code sections 22500 et. seq.) (the "Act') enables the City to form assessment districts for the purpose of maintaining public improvements; and WHEREAS, pursuant to Section 22623 of the Act, the City Engineer has filed in the Office of the City Clerk, and submitted for review to the City Council, a report entitled "Engineer s Report - Cloisters Landscaping and Lighting Maintenance Assessment District , dated May 3, 2021 prepared in accordance with Article 4 of the Act, commencing with Section 22565; and WHEREAS, pursuant to Section 22608.2 of the Act, the subdivider was required by City Ordinance to install improvements for which an assessment district was required to assure continued and uninterrupted maintenance of the Cloisters Park and Open Space; and WHEREAS, pursuant to the intent of Article XIII, Section 4, of the California Constitution, the property owners have elected to form the Cloisters Landscaping and Lighting Maintenance Assessment District. S OW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Morro Bay, S ection 1. The City Council approves the Engineer's Report. S ection 2. It is the intent of the Council to order the annual levy and collection of assessments for the Cloisters Landscaping and Lighting Maintenance Assessment District at a public hearing to be held at the Regular City Council Meeting on June 22, 2021, at or about 5 30 p.m , via teleconference in accordance pursuant to Section 3 of Executive Order N-29-20, issued by Governor Newsom on March 17, 2020. S ectiori 3. The improvements to be maintained at the Cloisters Park and Open Space are specified in the Engineer's Report dated May 3, 2021, which is hereby approved. S ection 4. The assessment upon assessable lots within the district is proposed to total $148,944 or $1,241.20 per assessable parcel for Fiscal Year 2021/22. S ection 5. Staff is directed to continue the Major Maintenance/Capital Improvement Program that will address items requiring significant expenditures in FY 2021/22. Any, projects identified with input from the community and shall be approved through the budget or budget amendment process by the City Council prior to implementation. The boundary diagrams are available for inspection at the office of the City Clerk during normal business hours.
