SPECIAL CLOSED SESSION MEETING –
OCTOBER 11, 2022 – 3:30 P.M.
TELECONFERENCE
Pursuant to Assembly Bill 361 (2021-22) and Government Code section 54953 this Meeting will be conducted
in a hybrid format with both in-person and virtual public participation.

ESTABLISH QUORUM AND CALL TO ORDER
Mayor Headding called the meeting to order at 3:30 p.m. with all but Council Member Addis present. Council
Member Addis joined the meeting at 3:33 p.m.
SUMMARY OF CLOSED SESSION ITEMS – The Mayor read a summary of Closed Session items.
CLOSED SESSION PUBLIC COMMENT – Mayor Headding opened public comment for items on the agenda.
T. Mastro spoke regarding the proposed bike connector trail being considered along Toro Lane and suggested
an alternate route along the east side of Highway 1 be considered.
Karl Levy, President of North Point Morro Bay Homeowners’ Association, submitted written comments and
spoke on behalf of the 10 property owners on Toro Lane, expressing opposition to the plan to use Toro Lane
for the connector trail.
Jim Shuler, Toro Lane property owner and former HOA President, expressed safety concerns and questioned
the County and City’s legal right to develop a connector trail along Toro Lane.
The public comment period was closed.
The City Council moved to Closed Session and heard the following items:
CS-1 CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to Government Code subdivision 54956.9(d)(2): One Matter
regarding the potential use of the easement over Toro Lane for a bike path connecting Cayucos and
Morro Bay
RECONVENE IN OPEN SESSION – The City Council reconvened in Open Session. The Council did not take
any reportable action in accordance with the Brown Act.
ADJOURNMENT - The meeting adjourned at 4:15 p.m.
